Welcome to Next-Play-Mode ("Platform," "we," "our," or "us"). By accessing or using our services, you agree to these Terms of Service ("Terms").

If you do not agree, you must not use the Platform.

If you are under 18 years old, a parent or legal guardian must review and accept these Terms on your behalf.

2. Description of Services

Next-Play-Mode provides a digital platform accessible via:

• Web application (nextplaymode.com)
• Mobile applications (including iOS and Android, when available)

The Platform offers:

• Mental performance and wellness assessments
• AI performance insights and development plans
• Weekly check-ins and progress tracking
• Nutrition planning workflows
• Real-time AI chat assistance
• Sports profile management
• Token-based rewards system
• Subscription-based memberships

Features may vary between web and mobile platforms.

3. Eligibility and Accounts

• Users must provide accurate and complete information
• Users under 18 require parental or guardian consent
• Parents/guardians are responsible for supervising minor accounts
• Users are responsible for maintaining account security

We may suspend or terminate accounts that violate these Terms.

4. Parental Consent and Minor Protection

For users under 18:

• A parent or guardian must create or approve the account
• Parents may access, review, and request deletion of their child's data
• We comply with applicable child protection laws, including COPPA

5. Subscription and Billing

Processed via Stripe:

• Basic: $12.95/month
• Pro: $19.95/month
• Elite: $39.95/month

Subscriptions renew automatically unless canceled.

6. Acceptable Use

Users agree not to:

• Use the Platform for unlawful purposes
• Harm, exploit, or harass minors
• Upload or share harmful content
• Attempt to hack, disrupt, or reverse-engineer the system

7. AI-Generated Content and Third-Party AI Models

Next-Play-Mode uses AI features powered by third-party providers accessed through intermediary services.

Important:

• We do not own or control AI models
• Providers and models may change at any time
• AI outputs are generated dynamically and may be inaccurate or incomplete

Disclaimer:

• AI content is for informational and educational purposes only
• It is not medical, psychological, legal, or professional advice

Limitation of Liability:

We are not responsible for:

• AI-generated outputs
• Errors or inaccuracies
• User actions taken based on AI responses

Users and guardians assume full responsibility for use of AI content.

8. AI Safety, Harmful Content, and Crisis Situations

Next-Play-Mode includes safety systems designed to monitor and manage high-risk AI interactions.

AI Safety Principles:

• The AI is not a crisis service, emergency service, or substitute for professional medical or mental health services
• It cannot provide emergency intervention or real-world assistance
• It is designed to reduce exposure to harmful or unsafe content

Harmful Content Handling:

If content involves:

• Self-harm ideation
• Violence or harm toward others
• Bullying or abusive behavior
• Dangerous or illegal intent

The system may:

• Restrict or refuse certain responses
• Limit or modify AI interaction behavior
• Apply automated safety filtering systems

Platform Rights:

We reserve the right to:

• Restrict or suspend AI access
• Review AI conversation logs that are flagged for safety concerns
• Take appropriate action to protect users and platform integrity
• Comply with applicable legal obligations, including reporting requirements where legally required

9. Educational and Institutional Use

Schools and organizations are responsible for compliance with applicable laws and consent requirements (including FERPA where applicable).

10. Rewards System

• Tokens have no monetary value
• Cannot be exchanged for cash
• May be modified or removed at any time

11. Intellectual Property

All content, software, branding, and systems belong to Next-Play-Mode or licensors.

12. Service Availability and Modifications

We may modify, suspend, or discontinue features at any time.

13. Termination

We may suspend or terminate accounts for:

• Violations of Terms
• Fraud or misuse
• Non-payment

14. Limitation of Liability

We are not liable for indirect or consequential damages. Total liability is limited to payments made in the last 12 months.

15. Governing Law

These Terms are governed exclusively by the laws of the United States of America.

16. Dispute Resolution

Users agree to first contact support to resolve disputes informally. Unresolved disputes may proceed to arbitration or U.S. courts.

17. Referral Program

17.1 Eligibility

• Coaches, parents, guardians, ambassadors, and adults (18+)
• Minors may share codes but earnings go to parent/guardian
• Self-referrals prohibited

17.2 Commission Structure

Tier 1 (1-1,499):

• Basic $0.40 | Pro $0.45 | Elite $0.50

Tier 2 (1,500-2,999):

• Basic $0.60 | Pro $0.65 | Elite $0.70

Tier 3 (3,000-4,999):

• Basic $0.80 | Pro $0.85 | Elite $0.90

Tier 4 (5,000+):

• All plans $1.00

17.3 Fraud Prevention

We may use:

• Device fingerprinting
• Email hashing
• Payment verification

17.4 Commission Reversal

Commissions may be reversed due to:

• Refunds or chargebacks
• Fraud
• Policy violations
• Eligibility issues

17.5 Referral Code Usage

• Non-transferable
• Must be used honestly
• May be revoked at any time

17.6 Leaderboard

• Public leaderboard may display top earners
• Display names only
• Participation is automatic

17.7 Commission Timing & Chargeback Protection

We may delay payouts up to 90 days to account for chargeback risk.

If chargebacks occur:

• Commissions may be reversed or deducted
• Losses may be offset from future earnings
